Mountain Law: Ardèche

Published in the official journal on October 16, 2020, the Mountain II law came into force on November 1, 2021. 48 departments, including Ardèche, were affected by the new provision with nearly 6,000 municipalities . Here is what the Mountain II law consists of and which municipalities are concerned in Ardèche!

WHAT IS MOUNTAIN LAW?

The decree of October 16, 2020 makes the use of special equipment mandatory during winter in part of the territory. You will therefore need to have and equip yourself with snow tires or other anti-slip devices depending on your vehicle, as soon as you enter an area affected by the decree.

This measure aims to improve the safety of motorists when driving on icy, snowy surfaces and during winter. Secondly, the decree aims to limit road blocking in mountainous regions.

Please note: if the decree officially came into force on November 1, 2021, it was a “white year” where prevention and education were essential to give motorists time to prepare. From November 2022, offenders will be penalized with a fine of €135 and, if necessary, by immobilization of the vehicle.

In the event of an accident, insurance may not cover the damage if the vehicle is not equipped.

  • Your insurer may ask you to prove that your wheels were equipped with the special equipment mentioned above.
  • There is a risk of not applying the contract guarantee .
  • Before hitting the road, remember to look at the guarantees in your insurance contract .

Beyond the legal aspect, this measure aims to promote your safety. In fact, when temperatures drop below 7°C, summer tires become less efficient .

WHICH COMMUNITIES IN ARDÈCHE ARE CONCERNED BY THE MONTAGNE 2 LAW?

169 municipalities are currently affected in the Ardèche department by the Mountain II law.

WHEN DO YOU KNOW THAT YOU ARE IN AN OBLIGATIONAL EQUIPMENT ZONE DURING WINTER?

Signs have been installed at each entrance and exit to the equipment obligation zone . The zone entrance is sign B58 and is represented by a white background bordered in red while the end of zone sign B59 is on a white background bordered in black with a black slanted line.

WHAT EQUIPMENT WILL YOU NEED TO HAVE TO TRAVEL IN THE ARDÈCHE?

For areas subject to the obligation of special equipment, all light vehicles, utility vehicles and motorhomes must either have special equipment or have their trunk with approved equipment.

In order to ride in zone B58, you need:

  • Or winter tires on all four wheels. Tires must be certified at best “3PMSF” (3 Peak Mountain Snow Flake) or at least “M+S”. Please note, however, that from November 1, 2024, the joint presence of the 3PMSF and M+S mentions will be mandatory (except for vehicles equipped with studded tires);
  • either have in your trunk a pair of metal snow chains or approved textile snow socks to be installed at least on the two driving wheels.

However, certain vehicles will have to equip yourself with both snow chains and winter tires. This is particularly the case for heavy goods vehicles with trailers or semi-trailers.
